Intelligent Health and Wellness (Pty) Ltd is a business in the health, wellness and beauty industry that develops and sells innovative nutricosmetics and supplements that promotes kindness to the body from within.

 

ONLINE SALES & PRODUCT PRICING AND AVAILABILITY
You will be charged the prices that are reflected on our website, subject to availability.

All prices shown on our website are in South African Rands (ZAR) and are valid and effective only in the Republic of South Africa and are inclusive of Value-Added Tax.

Special promotions may be subject to certain conditions, including stock availability and limited offer stipulations. Special promotions apply only to items on your original order (i.e. no discount can be added after the sale / special promotion has ended).

Online sales / special promotions are only valid for the period as stipulated in the campaign. No exceptions or discounts for late orders or orders placed after the sale / special promotion has ended.

All products, sales and promotions displayed on our website are subject to availability and will be delivered only within the Republic of South Africa.

We reserve the right to discontinue or change the specifications and/or prices of our products, sales and promotions from time to time without notice.

 

PAYMENT OPTIONS ACCEPTED
Payment may be made via Visa, MasterCard, Diners or American Express Cards or by bank transfer into the Intelligent Health and Wellness (Pty) Ltd bank account, the details of which will be provided on request.

 

CARD AQUIRING AND SECURITY
Card transactions will be acquired for Intelligent Health and Wellness (Pty) Ltd via PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. DPO PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.

 

CUSTOMER DETAILS SEPARATE FROM CARD DETAILS
Customer details will be stored by Intelligent Health and Wellness (Pty) Ltd separately from card details which are entered by the client on DPO PayGate’s secure site For more detail on DPO PayGate refer to www.paygate.co.za.

 

MERCHANT OUTLET COUNTRY AND TRANSACTION CURRENCY
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).

 

CONFIRMATION OF ORDERS
An order is deemed to be accepted when the customer receives an order confirmation email, and will thereafter be processed and delivered. We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order.

 

SHIPPING / DELIVERY POLICY
Subject to availability and receipt of payment, requests/orders will be processed and delivered within 2 -5 working days and delivery confirmed by way of email.

We deliver nationwide in South Africa.

Standard shipping is R115.

A delivery fee will be charged for each order below R950.

Free delivery for orders over R950.

Free gift for orders over R2000.

All orders will be dispatched via our delivery partners.

By placing your order, you accept that the goods will be delivered to any person at the delivery address. We do not have to prove that you personally received the goods, but rather that any person at the delivery address signed for the delivery.

 

EXPORT RESTRICTIONS
The offering on this website is available to customers within South Africa only.

 

ORDER CANCELLATION
If for any reason a customer would like to cancel an order, this may be done by visiting the “My Account” page on the website and completing the contact form, or by contacting Customer Care on +27 83 955 3175 / orders@motherkindco.co.za To request an order cancellation the customer will need to provide their order number.

Orders need to be cancelled within 1 hour after placing the order. Customers are liable for the delivery & return fees in respect of any late cancellations and/or in the case the parcel has already been collected by our delivery partners. Cancellation of orders by the customer may attract a 10% administration fee.

If the customer cancel their payment for any reason or if their payment card should cease to be valid for whatever reason, the customer will remain liable for the full purchase price, including all related costs. Intelligent Health and Wellness (Pty) Ltd reserve the right to cancel any sale and/or customer registration in the event of a breach of these Terms and Conditions and/or the terms and conditions stipulated on the website.

 

ACCURACY OF BILLING AND ACCOUNT INFORMATION
You agree to provide current, complete and accurate purchase and account information for all purchases made via our website. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can completeyour transactions and contact you as needed. You hereby indemnify Intelligent Health and Wellness (Pty) Ltd for any consequence/s, of whatsoever nature, as a result of any incorrect billing and account information which you may have provided to us.

 

RETURN POLICY
Intelligent Health and Wellness (Pty) Ltd offers a 7-day return policy, which means customers have 7 working days, after the delivery date to request a return, however, only in cases where the product is damaged, expired or defective.

To be eligible for a return, the return-goods must be in the same condition as upon delivery, unworn, unused, with tags, and in its original packaging. Customers would also need the receipt or proof of purchase together with their order number.

When contacting Intelligent Health and Wellness (Pty) Ltd please provide your order number as well as pictures as proof and reason for your return request. Intelligent Health and Wellness (Pty) Ltd reserves the right to decline any return request should the product/goods not be in the same condition as delivered (e.g. if the goods have been opened, used, damaged by the customer). If the return request is accepted, the customer will be sent a return shipping label, as well as instructions on how and where to return the package. Items returned without a return-request will not be accepted and refunded. Customers are liable for the return fees.

 

EXCEPTIONS / NON-RETURNABLE ITEMS
Certain types of items cannot be returned, e.g. perishable goods (such as food, flowers, or plants), custom products (such as special orders or personalized items), and personal care goods (such as beauty products). Intelligent Health and Wellness (Pty) Ltd also do not accept returns for hazardous materials, flammable liquids, or gases. Please contact Customer Care on +27 83 955 3175 / orders@motherkindco.co.za if you have questions or concerns about your specific order.

Unfortunately, Intelligent Health and Wellness (Pty) Ltd does accept returns on sale items or gift cards.

 

DAMAGES & ISSUES
Customers are to inspect the delivered item(s) upon receipt. Any defective, damaged or incorrect item(s) needs to be reported to Intelligent Health and Wellness (Pty) Ltd within 7 working days of delivery.

Intelligent Health and Wellness (Pty) Ltd will arrange collection of the return-goods and notify the customer via email once the return-goods have been received, inspected and whether the refund request has been approved or declined. If approved, refunds will be processed via EFT and the customer is to provide us with their banking confirmation details. Please be aware that it can take some time for the bank or credit card company to process and post the refund.

 

EXCHANGES
The provision of goods and services by Intelligent Health and Wellness (Pty) Ltd is subject to availability. In case of unavailability, Intelligent Health and Wellness (Pty) Ltd will, where possible, offer a substitute product or refund the client in full within 30 days.

Customers can request an exchange on their orders by contacting Customer Care on +27 83 955 3175 / orders@motherkindco.co.za. Intelligent Health and Wellness (Pty) Ltd reserves the right to decline any exchange request should the product/goods not be in the same condition as delivered (e.g. if the good have been opened, used, damaged by the customer).

 

REFUNDS

Intelligent Health and Wellness (Pty) Ltd shall take all reasonable steps to protect the personal information of its users/customers. For the purpose of this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA) and the Protection of Personal Information Act (PPI Act, POPIA). In the event of the invalidity of any part or portion of these Terms and Conditions for any reason whatsoever, such invalidity shall not affect the validity or enforceability of any other part or provision of these Terms and Conditions, and such invalid part or portion shall be deemed to have been struck out of these Terms and Conditions. No waiver by Intelligent Health and Wellness (Pty) Ltd in respect of the user’s/customer’s actions or omissions with regard to any breach, failure or default in performance by the user/customer, and no failure, refusal or neglect by Intelligent Health and Wellness (Pty) Ltd to exercise any right hereunder or to insist upon strict compliance with or performance of the user’s or customer’s obligations under these Terms and Conditions, shall constitute a waiver of the provisions hereof, and Intelligent Health and Wellness (Pty) Ltd may at any time require strict compliance with the provisions hereof.

 

GOVERNING LAW
The website and these Terms and Conditions are governed by and construed in accordance with the laws in force in the Republic of South Africa, and the user/customer consents to the jurisdiction of the South Gauteng High Court in the event of any dispute arising from or connected to the use of this website and the services. Intelligent Health and Wellness (Pty) Ltd chooses as its domicilium citandi et executandi for all purposes under this agreement at the details herein below on page 6. VARIATION Intelligent Health and Wellness (Pty) Ltd may, in its sole discretion, change these Terms and Conditions or any part thereof at any time without notice.
